TERMS AND CONDITIONS OF SKI EQUIPMENT RENTAL VIA THE INTERNET


General Terms and Conditions of Internet Sales. 
Booking and hire terms and conditions, “Cancellation, breakage or theft guarantee”, invoicing and cancellation terms.

PREAMBLE.

 

Our company, SR SPORTS SAS(RCS Chambéry 807 774 708, siège social : LD LES VIGNES BLANCHES - 73600 SALINS LES THERMES , France), owners of the trademark FREERIDE sell via the internet ski and associated equipment (boots, ski poles and helmets) hire.

Booking hire of ski or snowboard materiel or equipment via our web site implies that you have accepted our terms and conditions detailed below.

These terms and conditions govern the rental of ski and snowboard materiel to the client by FREERIDE, via the Internet. The Client, wishing to rent materiel from this website must first identify him or herself to become a client. To this end, he/she must fill in an online form, following the instructions on screen, where he/she will supply his/her surname, first name and postal address.  

In accordance with law number 78-17 of 6 January 1978 relating to computers, files and rights, the client has the right to consult and correct any files naming and relating to him/her.

The Client will definitively confirm his/her rental when he/she sees a summary of the hire details and “clicks” to show his/her acceptance of the general and specific terms and conditions detailed herein.

 

Definition of the CLIENT.

“Client” is defined as any person renting materiel from the website www.freeride.fr and proceeding to payment at this website. A Client may hire materiel for others, but will be the sole responsible party to FREERIDE.

 

Definition of FREERIDE.

FREERIDE is defined as a network of shops belonging or affiliated to the company SR SPORTS SAS, also as the website www.freeride.fr .

 

 Article 1: RESERVATION of hire materiel and TARIFS thereof.

Hire tariffs depend on the category of materiel rented by the Client from the categories proposed by FREERIDE.

The categories of materiel, and the tariffs applying thereto, are listed on the website.

FREERIDE reserves the right to modify these categories and applicable tariffs over the course of the season. The prices and discounts offered online at www.freeride.fr are only available for reservations made online and are unable to be offered directly in our shops.

The Family offer cannot be used in conjunction with either the 4 Pack or Group (8 Pack) offers.  The offer which gives the biggest discount will be applied automatically. The offer which has been applied will be shown in the ‘basket’ throughout the reservation process.

The 4 Pack offer can only be applied to a single reservation containing 4 sets of equipment. This offer cannot, under any circumstances, be applied retrospectively; either to a single order or to regroup several different orders.

The 8 Pack Group offer can only be applied to a single reservation containing 8 or more sets of equipment. This offer cannot, under any circumstances, be applied retrospectively; either to a single order or to regroup several different orders.

Any discount or promotional code needs to be entered at stage 1 of the reservation process on our website www.freeride.fr , only one promotional code or discount can be used per order. No refund will be given for a wrongly entered or forgotten promotional/discount code.  All promotional codes whether published online or via newsletter, are valid for a predetermined duration and in participating shops only.  Please contact our customer support for dates or find out our participating shops by clicking HERE

In the case of discounts through partnerships with specific companies / organizations, you will be asked to justify your membership and therefore any discount you have received, when you pick up your equipment in resort.

FREERIDE offers the 7th day of hire for free on all internet reservations with a minimum of 6 days.  This offer is for 7 consecutive days of hire.  To use this offer the client must select the specific duration of 6 days +1 Free at the beginning of their online rental.

FREERIDE will charge the user a booking fee in addition to the rental price. This fee amounts to one euro (€1) per set of equipment. This booking fee cannot be refunded in any case.

Article 2: PAYMENT for booking.

Payments must be made by bank card: cards showing the initials CB, cards carrying the “Visa” or “Mastercard” trademarks accepted in France, also cards issued within the international framework regulated by GIE Cartes Bancaires.

Confirmation of hire by means of supply of card number and expiry date is subject to there being sufficient funds available to pay the full cost of ski hire including all taxes.

The hire agreement will come into effect when the card issuer authorises payment. In case of refusal by the card issuer, our company reserves the right to cancel the booking.

FREERIDE reserves the right to cancel any hire if payment is rejected by the central network of Bank Card Issuers.

 

Article 3: 7 Day COOLING OFF PERIOD.

The Customer has a statutory withdrawal period of 14 calendar days, starting from the payment date of the booking.

However, this right of withdrawal may no longer be exercised if the Customer has already taken the equipment booked from the shop before the expiration of the 14 days period.

Any cancellation request must be notified directly to FREERIDE by e-mail to customerservice@freeride.fr. The customer can also use the contact form located in the "Contact" page of our website.

Refund of the payment will be made within a maximum period of 30 days by the credit card used when booking.

 

Article 4: Description of the “GUARANTEE”.

Online the “Guarantee” offered:

·         Covers cancellation (as per conditions detailed in article 5), and also breakage or theft (as per conditions detailed in article 8)

·         Costs 2€ per day and per skier for all categories.

·         Can only be taken before payment is made for hire, and cannot be added after this point.

      ·         The Guarantee will not be refunded in any case

In shops, the “Guarantee” offered:

·         Only covers breakage or theft (as per conditions detailed in article 8)

·         Costs 2€ per day and per skier for all categories

·         Can only be taken when the materiel is collected, and cannot be added later. 

·          The Guarantee will not be refunded in any case

 

Article 5: CANCELLATION of hire.

The cancellation procedure after the 14-day withdrawal period.

WITHOUT the “Cancellation, breakage or theft guarantee”

For the following, day “D” means the first day of HIRE.

If the Client HAS NOT taken the “Cancellation, breakage or theft guarantee” offered online, in case of total or partial cancellation a portion of the initial payment will be RETAINED.

In the case of complete cancellation, the AMOUNT RETAINED will be:

•    Up to and including D-7: 50% of the total cost of hire.
•    From D-6: 100% of the total cost of hire.

In the case of a partial cancellation (cancelation of certain materiel only), the amount retained will apply exclusively to the cancelled materiel.

WITH the “Cancellation, breakage or theft guarantee”

For the following, day “D” means the first day of HIRE.

If the Client HAS taken the “Cancellation, breakage or theft guarantee” offered online, he/she will benefit from preferential cancellation conditions.

In the case of cancellation, the AMOUNT RETAINED will be:

•    Up to and including D-7: NO RETENTION will be made.
•    Up to and including D-2: 50% of the total hire cost. 
•    From D-1: 100% of the total hire cost

Neither the Guarantee, nor the booking fee will be refunded in any case. In the case of a partial cancellation (cancelation of certain materiel only), the amount retained will apply exclusively to the cancelled materiel.

 

Article 6: Collection and use of hired materiel.

The client will receive an e-mail confirming hire. Only this mail containing a summary of hire terms and conditions constitutes confirmation and definitively validates the transaction.

If the Client finds he/she is unable to be present on the first day of hire which he/she has confirmed, the Client must inform FREERIDE in the shortest possible time by sending a message using the form available at https://www.freeride.fr/contact

The hired materiel will be delivered to the Client on presentation of a printed copy of the confirmation e-mail. In the absence of this we will require some form of identification from the Client along with the Order Number

FREERIDE will supply the CHOSEN skis, or an equivalent model from the same CATEGORY.

The materiel and equipment is destined solely for the use of the Client, without the possibility of lending or subletting to a third party even if not for profit. The Client is solely responsible from the moment he/she takes possession.

The Client is the sole judge of his/her ability to use the rented materiel or equipment, FREERIDE bases its hire solely on declarations made by the Client.

The earliest collection of ordered equipment can be from 3.30pm the day before the first ski day.

Article 7: Services

Snow Guarantee

In the event that, during the hire period, the ski lifts serving the ski area are less than 50% open for at least an entire day, the FREERIDE clients who have taken out the Snow Guarantee through the website https://www.freeride.fr will be able to ask for a refund of the day(s) that they have been unable to ski.

The percentage of closed lifts in the ski area served by the FREERIDE hire shop will be determined by either the tourist office of that resort or the lift company of that resort. Each client who has taken out the Snow Guarantee and who wants to use this guarantee will need to justify the percentage of lifts closed. This guarantee applies only when the ski area is less than 50% open for at least one entire day. Any refund request must be made by email to customerservice@freeride.fr. Refunds are only available on ski and snowboard equipment and will be made on a pro rata basis.

MultiRide / MultiGlisse

The Multi Ride service can be chosen at the second stage of the reservation process on www.freeride.fr. It allows each client who has paid for this service to change his equipment within the range he has paid for. For example skis to snowboard, or off piste skis to race skis. It is also possible to swap skis for snow shoes or a sledge.

The client who has taken out this service will be allowed to change his equipment a maximum of two times during the week (6 or 7 day hire), in the original hire shop and during the opening hours of this shop.

Supplementary mid-week service

This service is valid for one supplementary ski wax during the hire period. It includes the waxing and scraping of the hire ski which has been reserved with this service.

Overnight Storage

The client who has subscribed to this service is able to store his rental equipment overnight in the ski hire shop where the equipment was originally hired from.

Information concerning our ‘services’

Each of the services listed in Article 7 can be added to an order during the reservation process online for the amounts stated online at that time.  

Each service is only available from the specific shop offering that service. Our services can only be offered during the shop’s opening hours. FREERIDE is unable to provide these supplementary services outside of the normal opening times of the shop.

In the event of cancellation before arrival, services will be refunded in accordance with Article 5 of our Terms and Conditions, except the cancellation/damage and theft guarantee, which cannot be refunded in any event.

In the event of cancellation in resort, at the start or during the holiday, FREERIDE is unable to refund any service either on a full or partial basis.

 

Article 8: Conditions of RETURN of rented materiel and Client’s RESPONSIBILITIES.

Materiel must be returned to the shop from which it was taken.

The materiel must be returned at the end of the hire period specified and confirmed.

All materiel returned after 10 o’clock in the morning on the day following the last day of hire will be invoiced to the Client as supplementary days at the public rates on display in the shop.

If the Client is unable to return the equipment for whatever reason, he/she will be invoiced and must pay FREERIDE late fees in addition (as detailed in Article 8) to the hire fees already paid.

The equipment is supplied in good condition and must be returned in the same state. All of the materiel is numbered and trademarked and must be returned with the same numbers and trademarks. Any excessive damage, considered to have been caused by negligence on the part of the Client, will incur charges to the Client to replace or repair the equipment. The maximum charge for replacement/repair applied will be the cost of replacing the equipment “as new”. This sum will be in addition to hire fees already paid.

The client accepts that in the event a ski or snowboard can be repaired but not returned to a sufficiently safe state to continue renting it to the public, this ski will be considered ‘damaged beyond repair’ and the maximum amount for replacing the equipment ‘as new’ will be invoiced.  The client accepts that it is the qualified technician in the shop where the equipment was rented who will decide the seriousness and implications of any damage on the future rental of the broken equipment.

The Client expressly accepts that FREERIDE can appropriate, from his bank account, all sums due in case of late payment of CANCELLATION FEES or REPAIR/REPLACEMENT FEES, using the card number and expiry date supplied by the client.

 

Article 9: BREAKAGE or THEFT – Materiel not returned or returned broken.

FREERIDE may keep details of credit cards used by the Client for payment of hire, to permit compensation following the breakage or loss of one or more pieces of hired materiel, and/or to cover fees in case the Client does not return all the winter sports equipment he/she has hired (conditions defined in Article 7).
 FREERIDE may equally pre-authorise, at the time of payment, an amount equivalent to the total cost of hired winter sports equipment, charges as detailed below. These amounts will be debited from the card uniquely in the case of loss, theft or non-return of the hired equipment. This authorisation will cease to be valid from the moment the materiel is returned in good condition.
If the Client has not taken the “Cancellation, breakage or theft guarantee” offered online, nor the “Breakage or theft guarantee” offered on arrival at the shop, he/she will be INVOICED in the case of breakages or non-return of materiel (whether stolen or lost), according to the charges laid out below.
If the Client has taken the “Cancellation, breakage or theft guarantee” offered online, or the “Breakage or theft guarantee” offered on arrival at the shop, he/she will benefit from preferential conditions in the case of breakages or non-return of materiel hired from FREERIDE: he/she will be exempt from the full charges detailed above. The client must pay an excess corresponding to the values listed below:

15% will be deducted for every year a ski or snowboard has been in circulation.

In order to benefit from this guarantee, the Client must:
•         In the case of theft: supply a statement from the Police or the Gendarmerie to FREERIDE.
•         In case of breakage: return to the shop all damaged items (ski poles, skis, snowboards, bindings, boots and helmet)
This guarantee is non-transferable and is limited to one claim per trip.

Article 10: HIRE PERIOD SHORTENED by lack of snow, accident or death of a parent.

In the case of a lack of snow, FREERIDE does not refund unused hire days.

In the case of injury to a Client during their stay, and solely on presentation of supporting documentation (for example a doctor's certificate), FREERIDE will refund on a pro rata basis, starting on the day the equipment is returned to the shop, any ski days unused by the injured Client only.

In case of a client having to return home due to the death of one of his/her parents, and solely on presentation of accompanying documentation, FREERIDE will refund the Client or Clients directly affected on a pro rata basis, starting on the day the equipment is returned to the shop, any unused ski days

 

Article 11: Applicable RIGHTS and competent JURISDICTION.

This contact is subject exclusively to French law.

In case of any contest relative to this contract or any litigation, the competent tribunal will be that of the registered address of the company SR SPORTS SAS. (le tribunal de Chambéry) to which the parties give sole competence.

 

Article 12 : Carré + Insurance

Carré + Insurance covers Mountain Rescue and evacuation, and accidental damage or theft of your equipment hire. It covers a pro-rata refund for your lift pass, ski hire and ski lessons and also offers repatriation assistance.

IN THE CASE OF REPATRIATION:

Repatriation Assistance is offered to clients whose principal residence is based within the European Union or Switzerland. 

Any claims from clients residing outside the European Union or Switzerland will be judged on a case by case basis.
